Federal antitrust claims dismissed
US District Judge Amit Mehta granted Google’s motions to dismiss lawsuits by Chegg and Penske Media on September 30. The companies alleged that Google used their content in AI-generated search summaries and left them unable to withhold that content from AI Overviews while remaining in search results. They said the practice diverted readers and revenue. The judge found that their federal antitrust pleadings did not establish the required agreement or plausible market-based claims. Reuters reported the ruling on October 1.
What the ruling does not settle
The court also dismissed the plaintiffs’ state-law unjust-enrichment counts after declining to exercise supplemental jurisdiction once the federal claims were gone. That is not a decision on the merits of those state-law allegations. The opinion says a final, appealable order accompanies it. It does not establish that every use of publisher content in AI summaries is lawful or resolve separate copyright and licensing disputes.
